Do you need a fence permit in Bentonville or Rogers? Heights, setbacks, HOA and 811 rules with city sources. Free quotes for anything around your home, NWA.
Short answer: - Bentonville: yes. New and replacement fences need a fence permit. The fee is $30, and you'll need a site plan and a photo or cut sheet of the fence (City of Bentonville). - Rogers: usually no. Rogers "does not currently require fence permits," but a building permit is required if the fence is over 7 ft tall and/or has concrete footings (City of Rogers). - Everywhere: Arkansas law requires a call to 811 before digging, and your HOA may need to approve the fence too.

Check this first: fence posts are often set in concrete. Rogers' FAQ doesn't say whether concrete-set posts count as "concrete footings." Ask Rogers Community Development before you build, and keep their answer in writing. Outside city limits, Benton County rules apply instead.
City approval doesn't mean HOA approval. For example: - Bella Vista POA covenants require written Architectural Control Committee approval of the fence type, height, materials and location before you build (Bella Vista POA). - Rogers' Stoney Creek Place covenants ban front-yard fences and chain link (covenants).
Arkansas law requires homeowners to contact Arkansas 811 before digging, including for fence posts. Utilities have two working days to mark their lines (Arkansas 811).
