These Terms of Use ("Terms") apply to whitetailfence.com and any request you send through it or by email (together, the "Service"), operated by Whitetail Fence Co. ("Whitetail," "we," "us"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
Whitetail is a free matching service for homeowners in Northwest Arkansas. We take a homeowner's project request and try to match it with one independent local service provider ("Pro"). We are not a contractor. We don't perform, measure, install, build, repair, inspect or supervise any work, and we don't provide estimates or quotes for work.
Pros are independent businesses. They are not Whitetail's employees, agents, partners or representatives. Each request goes to one independent Pro. Whitetail does not do, oversee or guarantee the work. Each Pro alone is responsible for its quotes, pricing, scheduling, licensing, permits, insurance, safety, workmanship and compliance with law.
Any quote, contract, payment, warranty or other arrangement is solely between you and the Pro. Whitetail is not a party to it and is not responsible for enforcing it. Disputes about the work are between you and the Pro.
We'll try to match you, but we don't guarantee that a Pro will be available, will respond, will quote, or will quote any particular price. We don't guarantee the quality, timing, cost or outcome of any work. You're never obligated to accept a quote.
The Service is free to homeowners. Whitetail does not currently charge Pros or receive payment from them. If that changes, we will update these Terms and tell Pros in writing before any fee applies.
You're responsible for: - the accuracy of the information you submit and your right to share it - choosing whether to hire any Pro - checking a Pro's license (for example with the Arkansas Contractors Licensing Board, where required), insurance, references and reviews before hiring - getting written estimates and agreements - getting any permits and HOA approvals, and arranging utility locates (Arkansas 811) before digging
Guides, typical price ranges, directory listings and other content are general information only. They are not quotes, professional advice or a promise of any price. Directory listings are compiled from public sources, aren't paid, and are not endorsements or recommendations. Any rating we show is described as publicly reported, with its source and date. Information may be out of date; tell us at hello@whitetailfence.com and we'll aim to correct it.
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WHITETAIL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. WHITETAIL MAKES NO WARRANTY ABOUT ANY PRO OR ANY PRO'S WORK.
TO THE FULLEST EXTENT PERMITTED BY LAW, WHITETAIL AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS, INJURY, PROPERTY DAMAGE OR COST ARISING FROM ANY PRO'S ACTS, OMISSIONS, QUOTES OR WORK, OR FROM YOUR USE OF THE SERVICE. WHITETAIL'S LIABILITY IS LIMITED TO THE EXTENT THE LAW ALLOWS. Some jurisdictions don't allow certain limits, so some of these may not apply to you.
You agree to indemnify and hold Whitetail harmless from claims arising from your misuse of the Service or your violation of these Terms.
Don't submit false, unlawful or someone else's information, spam the forms, scrape the site in a way that harms it, or use the Service to harass anyone.
Pros who receive referrals agree that they are independent, are responsible for their own licensing, insurance and compliance, and contract directly with homeowners. Whitetail does not currently charge Pros for referrals.
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Arkansas.
We may update these Terms. The "Last updated" date shows the latest version. Continued use means you accept the changes.
